What Makes a Divorce Sale Different

How Nitin Handles a Queens Divorce Home Sale

  1. Private initial consult — with one or both spouses, in person or by phone.
  2. Written scope of engagement clarifying that Nitin represents the sale of the property, communicates with both spouses, and takes direction per the listing agreement or court order.
  3. Independent CMA based solely on OneKey® MLS sold comps — so price is objective, not contested.
  4. Coordinated launch — photography scheduled around living arrangements, showings controlled, lockbox use minimized where privacy matters.
  5. Parallel reporting — identical weekly updates to both spouses and both attorneys.
  6. Offer review with both sides before any counter — no surprises.
  7. Coordination with escrow attorney through closing.
Retain your own matrimonial or real estate attorney. Nitin does not provide legal advice, draft settlement language, or mediate distribution. Every divorcing spouse should have independent New York–licensed counsel. If you need an attorney referral, Nitin can point you to several he has worked with professionally.

Queens & Long Island Divorce Sale FAQ

"Can one spouse list the home without the other?" Generally no, if both are on the deed. A court order can modify this. Your attorney will advise.

"What if we disagree on price?" Nitin prices based on documented OneKey® MLS comps. Both sides get the same data at the same time.

"What about showings when one spouse still lives there?" Showings scheduled to respect the occupying spouse's access and privacy.

"Who pays commission?" Commission comes out of seller proceeds at closing and is typically split in the settlement per the matrimonial agreement or court order. Commission is negotiable and set in writing in the listing agreement [2].

"What about capital gains?" The IRC §121 primary-residence exclusion may apply (up to $250,000 single / $500,000 married filing jointly) [3]. Speak with your CPA — this is tax, not real estate, advice.
